什么叫引渡？引渡和遣返有什么區(qū)別？

引渡(extradition)是指國(guó)家根據(jù)條約或基于其他理由把在其境內(nèi)而被別國(guó)指控或判定犯罪的人，應(yīng)該國(guó)得請(qǐng)求，移交改過審判或處罰的行為。是國(guó)家之間刑事司法協(xié)助的一種形式。比如賴昌興目前身在加拿大境內(nèi)，但被我國(guó)指控有犯罪行為，我國(guó)向加拿大請(qǐng)求將其移交于我國(guó)進(jìn)行審判。加拿大應(yīng)請(qǐng)求移交的行為就是引渡。
