consideration特殊用法

法律文書中consideration有幾種譯法

最常見的，在英美法的合同法中，consideration翻譯成“對價”最合適，在合同contract中， 一方提出某種promise， 提供某些物品或者服務(wù)； 另一方提供consideration，一般是cash或者是 cash-convertible （支票 禮物Gfits）作為代價， 這個合同就是有法律效力的。另外一個比較常見的翻譯是“約因”，這個意思下相當(dāng)于cause了。

法律文書中consideration有幾種譯法

consideration是法律英語中極具代表性的一個術(shù)語，不僅因為其在法律英語中所表達(dá)的含義的特殊性，更因為其重要性。

我們知道consideration基本含義是“考慮”，但在法律合同中，它主要有兩個用法，(1) 作為鑒于條款，以in consideration of 這樣的短語出現(xiàn)；和(2) 譯為“對價”。
